1. Purpose
These terms of use set out the rules for accessing and using the Flowers mobile app, published by AVEC TROIS E, SAS, 47 quai Carnot, 92210 Saint-Cloud, France, Nanterre RCS 914 595 657 (“Flowers”, “we”). They apply to anyone who creates an account (“you”).
2. Acceptance
By creating an account, you accept these terms, as well as the subscription terms when you subscribe. If you do not accept them, do not use the service. The privacy policy describes how your data is processed.
3. Access and account
- The service is reserved for people aged 15 or over. If you are under 18, the subscription must be purchased with the agreement of your legal guardian.
- You sign in with your email address and a one-time code, or with your Apple or Google account. You provide accurate information and keep control of your mailbox and of these accounts.
- You are responsible for actions taken from your account. Tell us without delay about any unauthorised use; you can also sign out of all your sessions from your profile.
- An account is personal and cannot be transferred or shared.
- Creation features require a paid subscription, described in the subscription terms. Access to your account, your data, help and purchase restoration remains open without a subscription.
4. The service
Flowers is an app that supports short-video creation. In particular, it lets you define your creator profile, find inspiration, develop and test an idea before filming, write and version a script, prepare a shoot, analyse a video, talk with an AI coach and, once available, publish to connected networks and see the results they provide.
Features may change. We may add, modify or remove features for technical or legal reasons or to improve the service, without depriving a current subscription of its essential characteristics; any change that negatively affects your access is announced in advance, and you may then cancel.
5. Your content
You keep ownership of the videos, media, scripts, ideas and other content you import or create in Flowers (your “content”), as well as of the texts Flowers generates for you.
You grant AVEC TROIS E a non-exclusive, royalty-free, worldwide licence, limited to the time needed, to host, reproduce, transcribe, analyse, technically transform (for example to generate a preview) and transmit your content to our technical providers, solely to run the service at your request, including to publish it on the platforms you choose. This licence does not allow us to publish your content on our own behalf or to use it to train AI models. It ends when the content or the account is deleted, subject to the purge periods described in the privacy policy.
You guarantee that you hold the necessary rights to your content (images, music, trademarks, image rights of people filmed) and that it complies with the law and the rights of others.
6. Discover public references
Discover presents references to content published by other creators. Flowers does not host them: depending on the rights attached to their source, they are shown through the platform’s official embedded player or only cited through a link to their original page. They are there for inspiration: you may not reproduce this content without its authors’ agreement, and Flowers helps you adapt a format, not copy a video.
7. Connecting third-party platforms (coming soon)
- Connecting a TikTok, Instagram or YouTube account will be optional and subject to your authorisation, network by network. It will only be used to publish from Flowers and retrieve your results.
- When you connect a platform, you remain bound by its own terms and community rules, which you agree to follow.
- Flowers publishes only after you explicitly approve each post or schedule.
- Each network has its own status. A post is shown as published only after the platform confirms it. If it fails on one network, you can retry that network alone.
- Platforms may change or discontinue their interfaces; some features may then be limited.
- You will be able to disconnect an account at any time from the app or from the platform’s settings.
8. Analyses and AI output
The ideas, evaluations, scripts, analyses and advice Flowers provides are editorial observations and suggestions, produced in part by artificial intelligence systems. They may be incomplete or inaccurate.
- Flowers does not guarantee any number of views or followers, any engagement rate, any income or any performance, and does not predict a video’s results. An analysis performed before posting does not measure real retention.
- A suggestion changes your script only after your approval; it never changes your video.
- You review generated content and remain solely responsible for what you publish, including its accuracy and compliance with platform rules.
9. Prohibited uses
In particular, you agree not to:
- import or publish content that is illegal, hateful, violent, harassing, sexual content involving minors, defamatory, or that infringes the rights of others;
- impersonate anyone or use someone else’s account;
- circumvent security measures or attempt to access other users’ systems or data;
- extract data at scale, automate use of the service or resell it without written agreement;
- decompile or reverse engineer the app, except where permitted by law;
- use Flowers to produce spam, audience manipulation or misleading content, in particular generated or altered content presented as real in breach of platform rules;
- use the service in breach of the terms of connected platforms or of our AI providers’ usage policies.
10. Reporting and moderation
Your content stays private: Flowers does not make it public. Anyone can report content they consider illegal to contact@getflowers.app, stating what it is, where it is, why it would be illegal, and their contact details. This address is our single point of contact for users and authorities within the meaning of Articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act); we answer in French or English.
We review every report diligently. If we remove content or restrict an account, we tell you the reasons and the available remedies, unless the law prevents us from doing so. You can challenge our decision by replying to that message.
11. Flowers intellectual property
The app, its interfaces, texts, analysis methods, databases, and the Flowers name and logo are protected. We grant you a personal, non-exclusive, non-transferable right to use the app for your own needs while your account exists. No other right is transferred to you.
12. Availability
We make our best efforts to keep the service continuously available, but cannot guarantee it. It may be interrupted for maintenance, updates, incidents, or because of a provider or third-party platform. Where possible, we inform you of scheduled interruptions.
13. Suspension and termination
- You can delete your account at any time from the app. Deleting the account does not cancel a subscription bought through the App Store or Google Play: cancel it in your store settings.
- In case of a serious breach of these terms (for example a prohibited use), we may suspend or close your account, after informing you and, except in an emergency or where the law requires otherwise, giving you the opportunity to respond.
- Before any closure on our initiative, you can export your data where the law and the situation allow.
14. Liability
Flowers is responsible for properly performing the service under the conditions set by law. We are not responsible for the content you publish, the decisions you make based on suggestions, the performance of your posts, or malfunctions caused by third-party platforms, your device or your connection. Nothing in these terms limits your rights as a consumer, in particular the legal guarantee of conformity, or our liability for gross negligence, wilful misconduct or personal injury.
15. Changes to these terms
We may change these terms. Significant changes are notified to you in the app or by email at least 30 days before they take effect. If you do not accept them, you can delete your account and cancel your subscription before that date.
16. Governing law and disputes
These terms are governed by French law. If you live in another European Union country, you keep the benefit of the mandatory provisions of the law of your country of residence.
In case of a dispute, first contact support at contact@getflowers.app to seek an amicable solution. Under Articles L611-1 et seq. of the French Consumer Code, you can then refer the matter free of charge to the consumer mediator we are registered with, within one year of your written complaint to us:
[consumer mediator: name, postal address, website]
Failing an amicable solution, the dispute is brought before the competent courts under ordinary rules; as a consumer, you may in particular bring proceedings before the court of your place of residence.
